Whether you’re a family law solicitor managing a complex court case or an individual navigating a personal legal dispute, knowing where to start with DNA testing can often be the hardest part. Understanding the legal DNA testing process can often feel overwhelming, but it doesn’t have to be. At NorthGene™, we understand the profound impact these answers have on people’s lives and legal outcomes. That’s why we have streamlined the entire journey, from initial enquiry to the delivery of legally admissible results.
Step 1: Choose a Ministry of Justice approved laboratory
For DNA test results to be legally admissible in the UK court of law, the testing process must be carried out by a Ministry of Justice approved laboratory. If a lab lacks this specific government approval, the court will reject the evidence entirely.
As a leader in the industry, NorthGene™ is explicitly approved by the Ministry of Justice and UK Home Office. Additionally, NorthGene™ maintains full UKAS accreditation to ISO 17025, ensuring the highest levels of technical competence, quality assurance, and confidence in our results. We also hold a Human Tissue Authority (HTA) licence for the safe and ethical storage of DNA samples.
Step 2: Case registration
Every family dynamic and legal requirement is unique, which is why we don’t believe in a one-size-fits-all approach.
When approaching NorthGene™ for legal DNA testing, simply register a case with us – either through our secure online form or by completing the downloadable form and sending to our team at northgene@biofortuna.com. Upon receipt, we review the specific details of the case and provide a transparent, competitive quote in accordance with Legal Aid Agency guidelines. This means no hidden laboratory fees later down the line.
Step 3: Sample collection and the chain of custody
For a DNA test to hold up in court, strict chain of custody must be maintained throughout the entire process, starting at sample collection. To ensure absolute legal compliance, we manage this continuity for you from start to finish.
We can despatch our own fully trained sample collection network or your client can visit one of our walk-in clinics. Our nationwide collection network will be in touch with participants within 24 hours of receiving the case registration to arrange an appointment at a time and place that suits. They ensure that samples are collected with the utmost care, precision, and verify the identity of the person providing the sample.
You can learn more about our chain of custody process in our blog.
Step 4: Your sample collection appointment
We understand that attending a legal DNA appointment – whether at home, work, a solicitor’s office, or another location – can bring a wave of mixed emotions. Our collection network is trained to carry out appointments with the highest level of professionalism and empathy, ensuring your case is handled with dignity, privacy, and care.
To ensure the results are legally admissible, the sample collector must verify the identity of everyone involved before taking any samples. Every person being tested must provide:
- A valid form of photo ID (such as a driving licence or passport; a birth certificate is required for children).
- Two passport-sized photographs to confirm a true likeness to the individual. Alternatively, the sample collector can take a photo of the participant instead.
A NorthGene™ DNA test requires a simple buccal (cheek) swab from each participant. The collector will gently rub a swab against the inside of one cheek for around 20 seconds to collect buccal cells. This process will then be repeated on the other cheek, before both cheeks are sampled again using a second swab. The process is completely non-invasive, painless, and perfectly safe for adults, children, and newborn babies alike.
If you require a non-invasive prenatal paternity test for legal purposes, the sample collection process is slightly different. You can learn more about that specific process here.
Step 5: Laboratory analysis
Once sample collection is complete, the samples are safely sealed by the collector and returned to our UK laboratory in tamper-proof packaging for testing and analysis.
Testing begins immediately upon receipt of the samples to minimise the waiting time for families and legal teams.
Our expert team isolates the DNA from the buccal cells and compares 24 highly specific genetic markers across the profiles provided. A child inherits half their DNA from each parent, meaning every genetic marker in the child’s profile must match either the mother or the alleged father. Within each of these markers are different lengths of repeating DNA (called Short Tandem Repeats, or STRs) that vary from person to person. By analysing these inherited repeating sequences, we can determine biological relationships with more than 99.999% accuracy.
Step 6: Delivering Legally Admissible Results
Once all data is rigorously checked and verified, we compile a comprehensive report that meets all UK court specifications. This report details the chain of custody maintained and clearly states whether or not the biological relationship between participants has been confirmed or excluded.
The final report is delivered securely via email to the instructing party listed on the registration form (such as the principal solicitor on the case) within 1–2 working days.
